Know What to Expect When You Need a Notary
When people think of a notary, they often picture a quick signature and a stamp—but notarization isn’t always that simple. There are several types of notarization, each with its own purpose and legal requirements. Understanding the differences can help you know what to expect and ensure your documents are properly handled.
1. Acknowledgment
What it is: An acknowledgment confirms that the signer understands the contents of the document and signed it voluntarily. The signer must appear before the notary, but does not have to sign in their presence—they can sign ahead of time.
Common uses:
Deeds
Powers of attorney
Trusts
2. Jurat
What it is: In a jurat, the signer must swear or affirm that the contents of the document are true. The signer must sign in the notary’s presence.
Common uses:
Affidavits
Depositions
Legal statements
Note: This notarization requires the signer to take an oath or affirmation.
3. Oath or Affirmation
What it is: A notary administers an oral pledge of truthfulness. This may occur independently or as part of a jurat.
Common uses:
Court testimonies
Sworn statements
Oath = religious-based; Affirmation = secular
4. Signature Witnessing
What it is: The notary witnesses the signer’s signature and confirms their identity. Unlike an acknowledgment, this type of notarization requires the document to be signed in front of the notary.
Common uses:
Contracts
Consent forms
5. Electronic Notarization (eNotarization)
Definition: The notarization process utilizes digital signatures and seals. Although the documents are in digital form, the signer and notary remain in the same physical location.
Common uses:
Digital transactions
Remote office workflows
6. Remote Online Notarization (RON)
What it is: Using audio-visual technology, the notary and signer are in different locations. Identity verification and recordkeeping are crucial. (Note: Currently, in 2025, CA notary publics do not do Remote Online Notarizations.)
Common uses:
Real estate transactions
Time-sensitive documents
Signers out of state or overseas
Which Type Do You Need?
As a notary public, I am not allowed to decide which certificate you need. I can tell you that a jurat involves an oath and is used when you're swearing to the truth of the document. An acknowledgment is used when you're verifying that you signed the document willingly. I recommend contacting whoever gave you the document or an attorney.
